Terms and Conditions
Svonja Studio – Luka Švonja. This English version is provided for convenience. Only the German version is legally binding.
1. Scope
These terms and conditions apply to all offers, contracts and services between Luka Švonja, Svonja Studio (hereinafter “Designer”) and the client (hereinafter “Customer”). Deviating terms of the Customer are not recognised unless the Designer expressly agrees to their validity in writing.
2. Conclusion of contract & project start
A contract is concluded when both parties sign a project contract or when an offer is confirmed in writing (email is sufficient).
- For projects with a total value of up to €500.00, invoicing takes place after the services have been completed (unless agreed otherwise).
- For projects with a total value of more than €500.00, the Designer is entitled to request an advance payment (deposit) of 50% of the total fee. The Designer is entitled to start work only after receiving the agreed deposit.
3. Services, corrections & remuneration
- The scope of services is set out in the respective offer.
- Unless agreed otherwise, two rounds of corrections are included in the fee. Each further round of corrections as well as additional services (e.g. after acceptance) are charged at a flat hourly rate of €60.00.
- Travel costs, expenses and material costs are invoiced separately.
4. Payment terms & small business status
- All prices are final prices in accordance with § 19 UStG (small business regulation). No VAT is shown.
- Invoices are payable within 14 days without deduction.
- In the event of late payment, the Designer reserves the right to charge reminder fees and default interest in accordance with § 288 BGB (German Civil Code).
5. Copyright and rights of use
- The drafts and final artwork may not be altered, either in the original or in reproduction, without the express consent of the Designer. Any imitation, including of parts, is prohibited.
- The rights of use only pass to the Customer after full payment of the entire remuneration.
- Unless agreed otherwise, only a simple (non-exclusive) right of use for the agreed purpose and period is granted.
- Handing over open source files (e.g. .AI, .PSD, .FIG) is not part of the standard scope of services and must be paid for separately.
- The Designer may make appropriate use of the work developed as a reference for self-promotion (website, social media, portfolio).
6. Acceptance & duty to cooperate
- The Customer is obliged to provide the material required for the project (texts, images, logos) in good time and in digital form.
- Acceptance of the service must take place within 7 working days of delivery. If no written complaint is made within this period, the service is deemed accepted as free of defects.
7. Liability & legal review
- The Designer is only liable in cases of intent or gross negligence.
- Important: the Designer does not carry out any legal review (e.g. trademark, copyright or design law). Checking the legal admissibility of the drafts and logos is the sole responsibility of the Customer.
- The Customer is solely liable for the content provided by the Customer (images, fonts, licences).
8. Early termination
If the Customer terminates the project early, the Designer is entitled to remuneration for the services provided up to that point. Deposits already paid are retained as compensation for expenses if conception or design work has already begun.
9. Final provisions
- The law of the Federal Republic of Germany applies.
- The place of performance and jurisdiction is Offenbach am Main.
- Should any provision of these terms be invalid, the validity of the remaining provisions remains unaffected (severability clause).
